1.    This Consignment Agreement (agreement) is
between the consignor (owner) of the item (item) as indicated on the reverse
side of this form, and the consignee, Dutchess Bridle & Saddle, LLC (DBS).  

2.    The
consignment fee is
35% of the
selling price. This fee is non-negotiable and subject to change without notice.

3.    The owner represents that they have legal
title to the item, free and clear of any liens, interests or encumbrances by
any other party. 

4.    DBS shall offer the item for sale on behalf
of the owner. The selling price is determined by market value of the item in
its present condition. DBS assumes negotiating power on the behalf of the owner
following an agreement on the listing price and the lowest acceptable price.

5.    Consignment listing period is 6 months. The
consignor will be notified at 3 months and again at 6 months if the item(s)
have not sold. The item can be requested to be returned to the client at any
time at the consignor’s expense. If the item does not sell within 6 months, the
item may be returned to the owner or donated. The owner will be responsible for any shipping fees.   

6.    DBS makes no guarantee or warranty as to if
and when the item will sell. 

7.    We offer a secured, 10 day trial ride for
potential buyers. It is the potential buyer’s responsibility to pay for
shipping and any other fees associated with trying the saddle.

8.    Upon final sale of the item, DBS will pay
the owner the selling price less any consignment percentage or other applicable
fees. Preferred payment shall be made via Venmo or other electronic means. A
check can be issued by request. 

9.    Items
are sold as is.
Any
additional repair work needed to the item to make it saleable will be paid for in advance of the saddle being
listed. Items will not be accepted for consignment that require repairs beyond
a reasonable amount.

10. DBS will take every reasonable precaution
to ensure the safety of the item. DBS has made a note of all marks, scratches,
dings and other cosmetic markings on the item and can include a photographed
record of them with this signed agreement.

11. Excessively dirty, damaged, dry-rotted, and
out-of-date items are NOT accepted for consignment.

12. The risk of loss or damage to the item
shall be borne by the consignor. DBS does not assume the risk of a potential
buyer trying the saddle, acts of God, malicious acts, and normal wear and tear.

13. DBS reserves the right to terminate this
agreement at any time for any reason. 

14. In the event of any disagreement over the
terms of this agreement, New Jersey law shall govern. The State of New Jersey,
County of Sussex, shall have exclusive jurisdiction, and the owner agrees to
bind themselves to the jurisdiction of said courts. If DBS sues the owner to
enforce its rights under this agreement, owner shall be liable for all costs,
disbursements, and attorney’s fees incurred by DBS.

All item(s) must meet the following criteria to be accepted for consignment:

  • Any brand of English or Western saddle or tack including bits, bridles, reins, saddle pads, girths, stirrup irons, stirrup leathers
  • Must be in very good to excellent condition
  • Item(s) must be cleaned and in good working order
  • Any item valued under $1000 will be considered on a case by case basis
  • Older/out-of-date items and off or no-name brand name items are harder to sell and are generally not accepted
  • Items in need of extensive repair are not accepted

The amount of time it takes to sell a saddle is not predictable, and we can’t guarantee your saddle will be sold within a specific amount time.

We market consignment saddles online through various channels including our own website, eBay, social media as well as in person at saddle fitting appointments throughout the Northeast and in our store.

You can ship your saddle from anywhere in the US (see our shipping guidelines) or, if you’re in the area, stop by and drop it off during our business hours. We will also accept consignment saddles at saddle fitting appointments.

Once we have the item(s) in our possession, we compare it with similar item(s) available for sale online. We’ll make a pricing recommendation, but you’ll have final approval on the list price. We will also recommend a bottom acceptable price so we can accept offers or negotiate with a potential buyer to get the item(s) sold faster. A pricing agreement will be sent to the seller for final review before listing.

Due to the time it takes to process consignment item(s), we require a minimum of 3 months before returning the item(s) The seller will be responsible for shipping charges returning the saddle or tack item via UPS Ground.

Yes! We offer 10-day trials for all of our consignment saddles. Trials begin when the saddle is delivered to the customer. Because all saddle sales are final, we strongly recommend taking the saddle for a trial to ensure the best fit for our clients and their horses! Shipping charges are the responsibility of the potential buyer. Please refer to our Saddle Trial Policy for more details.

No, we cannot guarantee the sale of any saddle or consignment item. We do ensure that your saddle will be priced competitively and marketed widely enough for people to see!

We take a 35% commission on the final agreed selling price. Payment will be issued via the method chosen on the Consignment Pricing Agreement. Electronic payment is preferred however, we can issue a traditionally mailed check. Payments are made in the month following the sale of the saddle or tack item.
